TRADEX SINCE 1985 - PLATFORM TERMS OF USE
1. INTRODUCTION
1.1 About These Terms
These Terms of Use (“Terms”) govern access to and use of the TradeX Since 1985 online marketplace, website, mobile applications, trading systems, payment tools and associated digital services (collectively referred to as the “Platform”).
In these Terms, references to “TradeX”, “we”, “our” or “us” mean TradeX Since 1985 and its related entities, service providers, contractors and authorised operators.
1.2 Acceptance of Terms
By accessing, registering with, browsing, or using the Platform, you acknowledge that you have read, understood and agreed to be bound by these Terms together with any policies, guidelines or notices published on the Platform from time to time.
If you do not agree to these Terms, you must immediately cease using the Platform.
1.3 Nature of the Service
TradeX provides an online environment that enables members and users to advertise, buy, sell, exchange, promote and process transactions relating to goods and services.
Unless expressly stated otherwise, TradeX is not:
- the owner of listed goods;
- a party to transactions between users;
- an agent for buyers or sellers; or
- responsible for fulfilment, delivery or quality assurance of items traded through the Platform.

2.1 Right to Amend
TradeX may revise or update these Terms at any time where reasonably necessary to:
- comply with legal or regulatory obligations;
- improve system security or functionality;
- reflect operational or industry changes;
- correct errors or ambiguities;
- protect users, the Platform or TradeX’s commercial interests; or
- improve the efficiency or integrity of the Platform.

3. USER ELIGIBILITY & ACCOUNT REGISTRATION
3.1 Eligibility Requirements
To register or use the Platform, you must:

- comply with all applicable laws and Platform policies.
TradeX may refuse registration applications or suspend accounts at its discretion.
3.2 Account Security
Users are responsible for maintaining the confidentiality of their login credentials and for all activity occurring under their account.
You must immediately notify TradeX if:
- your account has been compromised;
- unauthorised access occurs; or
- you suspect misuse of your credentials.

4. MARKETPLACE OPERATIONS
4.1 Platform Role
TradeX operates solely as a digital marketplace and transaction facilitation platform. We do not verify:
- ownership of listed goods;
- legality of listings;
- quality or safety of products;
- accuracy of descriptions; or
- a user’s ability to complete a transaction.
Users transact entirely at their own risk.
4.2 Binding Transactions
When a seller publishes a fixed-price listing and a buyer completes the relevant purchase process, a legally binding agreement is formed directly between the buyer and seller.
TradeX is not a contracting party to that agreement.
4.3 User Responsibilities
Users are solely responsible for:
- complying with consumer and trading laws;
- ensuring listings are lawful and accurate;
- arranging payment and delivery obligations;
- resolving disputes directly with other users; and
- maintaining appropriate records of transactions.
4.4 Prohibited Listings
The following items or activities are prohibited on the Platform:
- unlawful goods or services;
- counterfeit or stolen products;
- offensive or discriminatory material;
- prohibited financial products;
- illegal wildlife trade;
- infringing intellectual property;
- unauthorised ticket resales;
- dangerous or restricted goods; and
- any item TradeX reasonably considers inappropriate.
TradeX may remove listings, suspend accounts or report activity to authorities where necessary.
5. DELIVERY & FULFILMENT
5.1 Delivery Arrangements
elivery arrangements are determined solely between buyers and sellers unless otherwise specified.
Available methods may include:
- electronic delivery;
- buyer collection;
- seller-arranged freight; or
- third-party courier services.
5.2 Seller Obligations
Sellers must:
- dispatch items within agreed timeframes;
- package goods appropriately;
- provide accurate shipping details; and
- retain proof of dispatch or collection where applicable.
5.3 Buyer Obligations
Buyers must:
- provide accurate delivery information;
- cooperate with reasonable delivery requirements; and
- pay any applicable delivery, customs or import costs unless otherwise agreed.

TradeX may, but is not obliged to, assist parties in resolving disputes relating to transactions conducted through the Platform.
Any involvement by TradeX does not constitute legal advice, arbitration or a binding determination.
6.3 Time Limits
7. DISCLAIMERS & LIABILITY
7.1 No Warranty
To the maximum extent permitted by law, the Platform is provided “as is” and “as available”.
TradeX does not guarantee:
- uninterrupted access;
- system availability;
- listing accuracy;
- transaction completion; or
- the quality or legality of goods or services offered.
7.2 Limitation of Liability
To the extent permitted by law, TradeX excludes liability for:
- indirect or consequential loss;
- loss of profits or revenue;
- data loss;
- business interruption;
- transaction disputes; or
- user misconduct.
Where liability cannot legally be excluded, it is limited to the resupply of services or the cost of resupply.
7.3 Indemnity
You agree to indemnify and hold harmless TradeX, its officers, employees and contractors from any claim, liability, damage or expense arising from:
- your breach of these Terms;
- misuse of the Platform; or
- disputes between you and another user.
8. SUSPENSION & TERMINATION
TradeX may suspend, restrict or terminate user access at any time where:
- these Terms are breached;
- unlawful activity is suspected;
- security concerns arise; or
- continued access may expose TradeX or users to risk.
TradeX is not required to provide reasons for suspension or termination unless required by law.
9. PRIVACY & DATA USE
By using the Platform, you consent to TradeX collecting, storing and using personal information in accordance with its Privacy Policy.
TradeX may communicate with users regarding:
- account activity;
- transaction notifications;
- operational updates;
- promotional material; and
- Platform announcements.
Users may opt out of marketing communications where legally required.
